Death by “Fairness”: The Hidden Tax on Personal Responsibility

An illusion of infinite choice greets you at the grocery store. Forty types of olive oil, dozens of laundry detergents, and a dizzying array of salad dressings could occupy a shopper for an hour. Yet, beneath this superficial variety, a fundamental type of choice quietly vanishes: the choice to balance risk against cost.
We often blame inflation on the "visible hand" of government policy. The state pumps more money into the market than the economy can handle. However, a hidden and more harmful force also drives prices higher. A "fairness premium" permeates our legal and regulatory landscape. In our pursuit of a world where no one ever suffers an accident, we inadvertently create a system fundamentally unfair to the vast majority of consumers.
The Vanishing Trade-Off
Legitimate protection shields consumers from the external malice of others: poison, trespass, or broken contracts. Classical thinkers defined this as commutative justice, often summarized by justice for the three Ps: Person, Property, and Promise. Today’s litigious society abandons this boundary. It seeks to protect people from their own choices.
This creates what thinkers like Nassim Taleb call "renormalization." It is a systemic hijacking where the preferences—or the misfortunes—of a tiny, stubborn minority dictate the costs for everyone else. This shift devolves from justice for the many into a specialized welfare program for the very few.
Individual judgment sits at the heart of a functioning market. Economies thrive when consumers decide if utility justifies price. However, a "safety-at-all-costs" mandate increasingly shapes the modern market.
Modern cars feature sensors, cameras, and structural reinforcements unthinkable thirty years ago. This represents a triumph of engineering. But beneath the surface, the regulatory floor rose so high the entry-level budget option vanished. When the government and the legal system mandate specific safety levels, they strip consumers of the right to make personal trade-offs. The state no longer allows us to weigh and manage our own risks.
The "Ralph" Paradox: A Lesson in Transfer Payments
To understand this real-world dynamic, consider a hypothetical product called "the Ralph." Suppose 100 people buy a Ralph. For 99 individuals, the product works exactly as intended, providing value and utility. However, one consumer, perhaps through misuse or misfortune, hurts themselves using it.
In a system obsessed with a narrow definition of "fairness," this one individual seeks restitution. They sue the manufacturer. Because the legal system favors settlements over the high cost of discovery and trial, the manufacturer pays a significant sum regardless of actual fault.
The manufacturer does not simply absorb this cost. They treat it as a cost of production, much like raw materials or labor. Since the manufacturer knows a single person's unvalidated hazard from using the product will create a payout, they build in excessive safeguards to protect against the legal strategy of the very few, but at the great cost to the many. Since the many do not value those safeguards.
Consequently, the price of the Ralph rises for the next 100 consumers.
This is inflation driven by the "fairness premium." We effectively create a mandatory insurance scheme where 99 happy consumers subsidize one unhappy consumer. This triggers a destructive "moral hazard." Attempting to insure away peril actually increases the likelihood of those perils occurring. Insurance industry standards and academic risk management research confirm this principle: eliminating the consequences of actions inevitably encourages more of the same risky behavior. Without "skin in the game," individuals abandon caution. We effectively subsidize recklessness, then wonder why the world feels more dangerous. This micro-society experiences a clear negative in net welfare. High prices restrict access to the product, leaving the 99 poorer.
The Legal Tariff
This legal dynamic functions almost exactly like a trade tariff. A tariff protects a small group of domestic producers at the expense of millions of consumers paying higher prices. This welfare transfer shrinks the overall pie.
Our modern liability culture imposes a "legal tariff" on innovation and affordability. It creates a barrier to entry favoring large, entrenched corporations with massive legal departments, while stifling the small competitor offering a simpler, cheaper alternative. By trying to eliminate the risk of the "one," we compromise the prosperity of the "many."
The Illusion of Safety
True fairness exists not in the absence of risk, but in the presence of liberty. When the legal system acts as a central planner, it distorts the signals driving a market. It dictates mandatory features and sets the price a manufacturer pays for an outlier's accident.
The "fairness premium" acts as a hidden tax on every American. Prices remain high even when supply chains stabilize. "Choice" feels like a mile-wide river only an inch deep. We traded the freedom of the individual for a collective safety net slowly strangling the economy.
Individual justice remains essential. A manufacturer knowingly creating a harmful product must face accountability. However, the pendulum swung too far. The cost of justice now looms so high manufacturers would rather eliminate choice and inflate costs for the many to dodge frivolous legal action from the few.
Addressing the rising cost of living requires looking beyond the printing presses of central banks. We must ask if a system penalizing the 99 to insulate the one truly offers fairness. It simply paves a well-intentioned path to a poorer, less free society. True economic justice lies in allowing individuals to navigate their own risks. No one should force them to pay for a "safety" they neither want nor need.
So, what should you do?
The answer is simple. Expose yourself to small risks.
Buy products with reasonable safety standards, but avoid paying for the few driving higher prices. For example, the next time you are car shopping, choose a base model of an older, used car. You accept fewer safety gizmos because you intend to be a safe driver. You become the primary safety feature. In exchange, you get a much lower price.
Raise your medical, car, and housing insurance deductibles. Avoid insuring small risks, such as a cracked smartphone screen. This strategy, de-moral hazarding, achieves two critical goals:
First, it slashes insurance costs. High deductibles signal a willingness to bear small risks. Insurance companies respond by lowering premiums. You can then invest these savings to build personal wealth.
Second, accepting small risks sharpens your focus. You pay more attention to managing your daily life when you have skin in the game. This heightened awareness leads to a healthier, more intentional, and ultimately happier existence. Stop paying for the "fairness" of others and start investing in your own responsibility.
